TERMS AND CONDITIONS

Acceptance of Terms and Conditions
All bookings accepted by My Home SP Limited are subject to these Terms and Conditions that are deemed to have been accepted in full by the Client/Guest. Payment of a Reservation Fee or Rent Balance also indicates acceptance of these Terms and Conditions.
General
Renting apartments from My Home SP is not intended to create the relationship of Landlord and Tenant between us and the Client/Guest. My Home SP is the point of contact between the Client/Guest and the Landlord.
Reservations
Your Reservation is only confirmed when we email written confirmation of booking following receipt of payment of the Reservation Fee. When a reservation is made, a Reservation Fee of 10-20% of the total balance (dependent on length of stay) is required in advance to confirm the booking. The balance of the Rent Balance is to be paid 10 days before the arrival date. If we do not receive full payment by this time, the reservation may be cancelled and the Reservation Fee forfeited. The Client/Guest may be liable for the balance of the Rent Balance and for any other costs involved in the attempt to re-let the apartment. When a booking is made less than 10 days prior to the arrival date, the full Rent Balance is required to confirm the reservation.
Security Deposit
The security deposit payment must be received my My Home SP previous to check in. Check in will not go ahead until such time as the deposit has been received. The security deposit protects the owner in case of losses or damage caused voluntarily or involuntarily to the property, its contents or other guests.
Extensions
Clients/Guests wishing to extend their stay are required to give at least 15 days notice, subject to the apartment or an alternative being available. Extension of a reservation that has already commenced will be treated as a new reservation. A new contract must be signed upon confirmation of an extension and any monies paid are non-refundable.
Payment
Payment must be made in Brazilian Reais and must be clear of all bank charges, exchange rate variations and any other deductions. We accept the following methods of payment: Bank Transfer to our bank account, E-check, Paypal (additional fees will apply) Visa, MasterCard and Amex (for reservations made by credit card, a transaction charge will be incurred of 5% of the total payable). Under no circumstances will accommodation be provided until we have received cleared funds to cover the Rent Balance

Failure to pay in accordance with the agreed terms of payment may result in suspension of accommodation.
Occupants
Only Guests specified by name at the time of booking by the Client/Guest may occupy the apartment. The Client/Guest must not assign, sublet or part with or share possession of the apartment or any part of it. My Home SP reserves the right to refuse admittance to the Guest if they are in breach of this condition.
Date Changes
A change of arrival date or departure date by the Client/Guest may be accommodated if possible. This may imply additional cost.
Cancellation Policy
Cancellations must be notified to us in writing immediately. When notification of cancellation is received more than 28 days prior to the arrival date, all payments will be refunded after deducting the Reservation Fee which is forfeited.

When notification of cancellation is received less than 28 days prior to the arrival date, the Reservation Fee and first month's rent is forfeited. The refund of other payments is subject to the accommodation being re-let and owner's agreement. The refund is less the rent for any part of the contracted occupancy during which the accommodation remains vacant.
Rental Charges
The Rent Balance includes utility charges, Cable TV and Internet. Telephone line usage (where available) and maid service are charged separately at cost.
Arrivals & Departures
Apartments are available for check in at 3pm on the day of arrival. An earlier or later check in can be arranged though a early/late check in fee may apply. Not all properties are available for check in outside of business hours (08:30 am – 18:00 pm). Check out time is 11:00 am on the day of departure. An earlier or later check in can be arranged though an early/late check out fee may apply.
Keys
Keys will be provided for the apartments and are to be returned in line with the departure terms as above. For any keys not returned, there will be a R$ 150 charge. If the Client/Guest loses or misplaces their keys during occupation and require assistance to gain entry, an additional charge of R$ 150 will be made.
Broadband
Broadband internet access is provided in most apartments. Although we will endeavour to assist with any connection problems, My Home SP accepts no responsibility for the inability to connect to this facility.
Property Use & Conditions
The Client/Guest is responsible for taking all reasonable care of the apartment and its contents. The apartment and all equipment, utensils, furniture etc. must be left clean and tidy at the end of the Rental Period. No items may be removed from the apartment. Except in the case of normal wear and tear the Client/Guest will be responsible for covering all costs incurred for repair of apartment or replacement of its contents which have occurred due to negligence, wilful damage or irresponsible behaviour on the part of the Client/Guest or their visitors. Such damage must be reported to us without delay.

In the event that breakages or damage are discovered, or extra cleaning required, after departure, we will notify the Client/Guest in writing within 7 days of departure, providing detail of the issues and an invoice for the cost of rectifying them. My Home SP will not be held responsible for any personal injury, loss or damage to personal effects howsoever arising at the apartment or in the apartment block or its grounds.

Smoking is not permitted in the apartments unless otherwise specified.

Complaints
Any Complaints must be made in writing immediately to My Home SP.
